In a surprise announcement on
September 3, 2003, the Treasury Department and the IRS announced
that over-the-counter drugs can be paid for with tax-free
dollars through health care flexible spending accounts. This
change has come about because more and more prescription drugs
are becoming available over-the-counter without a prescription.
Many health plans, including those administered by ERS, do
not cover the drugs once they become available over-the-counter.
ERS and PayFlex are working together to establish policies
and procedures. In the meantime, keep all receipts if purchasing
over-the-counter drugs. You will need them as documentation
when filing a claim for reimbursement.
